Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Krend (the "Service"), you ("Customer," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization, and "you" refers to that organization.

2. Description of the Service

Krend provides an API and dashboard that allow Customers to collect customer review data and receive AI-generated analysis of that data, including sentiment classification, bug/issue detection, and summarized insights (the "Analysis"). Krend acts as a data processor with respect to review content Customers submit through the API, and as a data controller with respect to Customer account information.

3. EXCLUSIVE BETA — NO FEES, NO GUARANTEES, ASSUMPTION OF RISK

THIS SECTION IS MATERIAL. READ IT BEFORE USING THE SERVICE.

The Service is currently offered as an exclusive beta ("Beta"). By using the Service during the Beta, you specifically acknowledge and agree:

• No fees are currently charged: Krend does not collect payment information during the Beta. Krend reserves the right to introduce fees for the Service in the future. Continued use will require your explicit, affirmative acceptance of updated pricing terms.
• No uptime or continuity guarantee: Beta software is inherently unstable. Features, endpoints, pricing plans, and the AI provider(s) used to generate Analysis may change, break, or be removed at any time, with or without notice.
• Risk of data loss & permanent deletion: Your account and associated data may be lost or deleted as a result of Beta instability, and separately as a result of account deletion, which is immediate and permanent with no recovery option (see Section 14).
• Suspension or termination: Krend may suspend, limit, or terminate your access to the Service, or discontinue the Service or Beta entirely, at any time, in its sole discretion, without liability to you.
• You use the Service during the Beta entirely at your own risk.

4. AI-Generated Analysis — Accuracy Disclaimer

THIS SECTION IS MATERIAL. IT LIMITS KREND'S LIABILITY FOR THE CORE FUNCTION OF THE SERVICE.

The Analysis is generated using third-party AI models and is provided for informational purposes only:

• AI-generated output may be inaccurate, incomplete, biased, or misleading, and may misclassify sentiment or detect issues incorrectly. False positives and negatives are normal and not a defect.
• Krend makes no warranty, express or implied, as to the accuracy, completeness, reliability, or fitness for any purpose of any Analysis.
• Customer is solely responsible for independently reviewing and verifying any Analysis before relying on it for business, engineering, financial, or legal decisions.
• Krend is not liable under any circumstances for any loss, damage, missed issue, or business decision arising from reliance on AI-generated Analysis.

5. Accounts and Registration

You must provide accurate registration information and keep it current. You are solely responsible for safeguarding your account credentials and API keys and for all activity occurring under them. Notify Krend immediately of any suspected unauthorized use.

6. API Keys

API keys are issued for Customer's integration with the Service. Customer must not share, publish, embed in client-side code, or expose API keys in publicly accessible locations. Krend may rate-limit, suspend, or revoke any API key at its sole discretion, including on suspicion of abuse.

7. Acceptable Use

Customer agrees not to submit content that is unlawful, malicious, contains special categories of personal data (health, biometric, religious belief, etc.) without prior agreement, or violates applicable law.

8. Data Ownership and Customer Responsibilities

Customer retains ownership of the review data it submits. Customer represents and warrants that it bears sole responsibility for having all necessary rights, consents, and legal bases under applicable law (including DPDP, GDPR, and CCPA/CPRA) to collect and transmit its end users' review data to Krend.

11. NO WARRANTY

To the maximum extent permitted by applicable law, the Service is provided "AS IS" and "AS AVAILABLE," without warranty of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted operation.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Krend's total aggregate liability arising out of or related to these Terms or the Service shall not exceed a nominal sum ($50 / ₹5,000). In no event shall Krend be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.

14. Termination and Account Deletion — NO RECOVERY

Either party may terminate at any time. Account deletion is IMMEDIATE AND PERMANENT. There is no grace period, recovery window, or undo mechanism during the Beta. Once deletion is confirmed, your account data, submitted review content, and derived Analysis are permanently purged from our production systems and cannot be restored under any circumstances.
